{"id":319,"date":"2017-01-06T14:55:40","date_gmt":"2017-01-06T12:55:40","guid":{"rendered":"http:\/\/ulusehiryangindanismanlik.com\/v5\/?page_id=319"},"modified":"2020-02-10T11:49:53","modified_gmt":"2020-02-10T08:49:53","slug":"mevcut-yapi-inceleme-ve-durum-tespiti","status":"publish","type":"page","link":"https:\/\/ulusehiryangindanismanlik.com\/v5\/mevcut-yapi-inceleme-ve-durum-tespiti\/","title":{"rendered":"Mevcut Yap\u0131 \u0130nceleme ve Durum Tespiti"},"content":{"rendered":"<p style=\"text-align: center;\"><strong>Mevcut Bina, Yap\u0131 \u0130nceleme ve Durum Tespiti<\/strong><\/p>\n<p>Mevcut binalar\u0131n y\u00f6netmeli\u011fe uygun hale getrilmesi, &nbsp;T\u00fcrkiye Binalar\u0131n Yang\u0131ndan Korunmas\u0131 hakk\u0131nda &nbsp;Y\u00f6netmeli\u011fi &nbsp;MADDE 168 (1)&#8217;e g\u00f6re uyumsuzluk durumunda yasal a\u00e7\u0131dan &#8220;5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu ve 5236 say\u0131l\u0131&nbsp;Kabahatler Kanunu h\u00fck\u00fcmleri uyar\u0131nca i\u015flem yap\u0131laca\u011f\u0131\u201dn\u0131n belirtilmesi sebebiyle \u00f6nemli bir konudur.<\/p>\n<p>Mevcut binalar\u0131n y\u00f6netmelik h\u00fck\u00fcmlerine uygunlu\u011funun s\u0131nanmas\u0131 i\u00e7in a\u015fa\u011f\u0131da belirtilen hizmetleri sunmaktay\u0131z:<\/p>\n<ul>\n<li>&nbsp;Saha inceleme<\/li>\n<li>&nbsp;Proje \u0130nceleme<\/li>\n<li>&nbsp;Durum Tespiti raporu haz\u0131rlanmas\u0131<\/li>\n<li>Binalar\u0131n yang\u0131ndan korunmas\u0131 hakk\u0131nda y\u00f6netmeli\u011fe g\u00f6re mevcut bina ve yap\u0131 kapsam\u0131nda incelenerek raporland\u0131r\u0131lmas\u0131<\/li>\n<li>Master Plan Olu\u015fturma<\/li>\n<\/ul>\n<p>T\u00fcrkiye Binalar\u0131n Yang\u0131ndan Korunma Hakk\u0131ndaki&nbsp; Y\u00f6netmeli\u011fi &nbsp;Madde 169&nbsp;GE\u00c7\u0130C\u0130&nbsp;MADDE 1- (1)\u2019e g\u00f6re&nbsp;Mevcut binalar hakk\u0131nda al\u0131nacak tedbirler ile ilgili yap\u0131m s\u00fcresi&nbsp;a\u015fa\u011f\u0131da belirtildi\u011fi gibidir:<\/p>\n<p><em>&#8220;Bu Y\u00f6netmeli\u011fin Onuncu K\u0131sm\u0131nda belirtilen mevcut binalar&nbsp;i\u00e7in yang\u0131na kar\u015f\u0131 al\u0131nmas\u0131 gereken tedbirler, bina sahibi ve y\u00f6neticisi ile kurum amirleri&nbsp;taraf\u0131ndan 1 y\u0131l i\u00e7inde yerine getirilir. Bu s\u00fcre i\u00e7erisinde, al\u0131nacak tedbirlerin gerekli k\u0131ld\u0131\u011f\u0131&nbsp;tesisat\u0131n yap\u0131m\u0131na ba\u015flan\u0131lm\u0131\u015f ise, yap\u0131m s\u00fcresine ba\u011fl\u0131 olarak ilgili idare taraf\u0131ndan 1 y\u0131l\u0131&nbsp;a\u015fmamak \u00fczere yap\u0131m s\u00fcresi tan\u0131nabilir.&#8221;<\/em><\/p>\n<p>T\u00fcrkiye Yang\u0131ndan Korunma Y\u00f6netmeli\u011fi 2009 Madde 138\u2019e g\u00f6re mevcut binalarla ilgili h\u00fck\u00fcmler a\u015fa\u011f\u0131da belirtildi\u011fi gibidir:<\/p>\n<p><em>(&#8220;1) Mevcut yap\u0131lardan bu Y\u00f6netmeli\u011fin y\u00fcr\u00fcrl\u00fc\u011fe girmesinden sonra kullan\u0131m amac\u0131 de\u011fi\u015ftirilerek, bedensel veya zihinsel bir hastal\u0131\u011f\u0131n veya yetersizli\u011fin tedavisinin veya bak\u0131m\u0131n\u0131n yap\u0131ld\u0131\u011f\u0131 veyahut k\u00fc\u00e7\u00fck \u00e7ocuklar, nekahet h\u00e2lindeki ki\u015filer veya bak\u0131ma muhta\u00e7 ya\u015fl\u0131lar\u0131n bak\u0131mlar\u0131 i\u00e7in kullan\u0131lan sa\u011fl\u0131k ama\u00e7l\u0131 bina ve tesisler ile yat\u0131l\u0131 sa\u011fl\u0131k kurulu\u015flar\u0131, anaokullar\u0131, kre\u015fler, \u00e7ocuk kul\u00fcpleri, ilk\u00f6\u011fretim okullar\u0131, yeti\u015ftirme yurtlar\u0131, e\u011flence yerleri ve konaklama ama\u00e7l\u0131 olarak kullan\u0131lacak bina ve tesisler ile tehlikeli maddelerin bulundurulaca\u011f\u0131 binalar d\u0131\u015f\u0131nda kalan mevcut yap\u0131lar hakk\u0131nda bu K\u0131s\u0131m h\u00fck\u00fcmleri uygulan\u0131r.<\/em><\/p>\n<p><em>(2) Mevcut yap\u0131lardan, 12\/6\/2002 tarihli ve 2002\/4390 say\u0131l\u0131 Bakanlar Kurulu Karar\u0131 ile y\u00fcr\u00fcrl\u00fc\u011fe konulan Binalar\u0131n Yang\u0131ndan Korunmas\u0131 Hakk\u0131nda Y\u00f6netmeli\u011fe uygun yang\u0131n tedbirleri al\u0131nm\u0131\u015f olan yap\u0131larda, bu Y\u00f6netmelik h\u00fck\u00fcmlerine g\u00f6re ilave tedbir al\u0131nmamas\u0131 as\u0131ld\u0131r.
